Terms of Use

These Terms of Use govern your use of palmpush, including the website, iOS app, API, JavaScript SDK, PWA SDK, and related services. By using palmpush, you agree to these terms.
1. Operator

2. Service
palmpush lets you create private notification listeners and send short title and body push notifications to devices or browsers that subscribe to those listeners.
The current version is provided free of charge. It does not currently include paid subscriptions, in-app purchases, service-level commitments, or paid support. We may change, limit, charge for, suspend, or discontinue palmpush or parts of palmpush in the future.
3. No accounts and listener tokens
palmpush does not currently provide user accounts or password-based ownership. Listener tokens are the main access mechanism.
A listener token is a secret capability token. Anyone who has a listener token may be able to send notifications to that listener, subscribe another device, rename the listener, or change listener-related settings.
You are responsible for keeping listener tokens private. Do not publish listener tokens in public repositories, client-side code that should not contain secrets, screenshots, logs, support requests, or other places where unauthorized people can access them. If a token is exposed, create a new listener and stop using the exposed token.
4. Use at your own risk
palmpush is provided as a free, lightweight notification utility. You use it at your own risk.
Do not use palmpush for emergency alerts, safety-critical systems, medical systems, security monitoring, financial trading, compliance monitoring, production incident response, or any situation where a missed, delayed, duplicated, incorrect, or unauthorized notification could cause harm.
Push delivery depends on device settings, browser settings, notification permissions, network availability, operating systems, battery-saving behavior, Apple services, Google/Firebase services, browser push services, and other systems outside our direct control. We do not guarantee that any notification will be delivered, delivered on time, displayed, stored, or retrievable.
5. Your responsibilities
You are responsible for:
- Using palmpush only in a lawful manner.
- Having all rights and permissions needed for the content you send.
- Keeping listener tokens and integration credentials secure.
- Choosing notification content that is appropriate for push delivery.
- Not sending secrets, passwords, payment data, health data, highly sensitive personal data, or confidential business information unless you understand and accept the risks.
- Complying with platform rules, app store rules, browser rules, developer terms, and laws that apply to your use.
- Monitoring your own systems instead of relying on palmpush as the only source of truth.
6. Acceptable use
You may not use palmpush to:
- Break the law or violate another person's rights.
- Send spam, harassment, threats, abusive content, deceptive content, or misleading notifications.
- Send content that is unlawful, defamatory, discriminatory, invasive of privacy, sexually exploitative, or otherwise harmful.
- Attempt to gain unauthorized access to palmpush, other users' listeners, or third-party systems.
- Probe, scan, overload, disrupt, scrape, attack, reverse engineer, or bypass technical limits of the service, except where applicable law gives you a non-waivable right to do so.
- Use palmpush for malware, phishing, credential harvesting, surveillance, or other abusive activity.
- Resell palmpush or provide it as a critical dependency for third parties without written permission.
- Use automated traffic that creates unreasonable load or degrades the service.
7. Notification content and history
You are responsible for all notification titles, bodies, listener names, and other content you send or store through palmpush.
palmpush may store notification titles and bodies as delivery history so subscribed devices can show past notifications and so delivery issues can be diagnosed. Do not send content through palmpush if you do not want it processed or stored as described in the Privacy Policy.
8. API and SDK use
You may use the palmpush API, JavaScript SDK, and PWA SDK only as intended by the documentation and these terms. We may add limits, remove abusive traffic, rotate infrastructure, reject malformed requests, or change API behavior where needed to operate, secure, or improve the service.
Unless we agree otherwise in writing, palmpush provides no uptime commitment, support commitment, maintenance commitment, data export commitment, or backwards compatibility commitment.
9. Privacy
The Privacy Policy explains how palmpush processes information. By using palmpush, you acknowledge that notification delivery and listener history may require processing device IDs, push tokens or Web Push subscriptions, listener tokens, notification titles and bodies, delivery status, logs, and support data.
10. Third-party services
palmpush relies on third-party infrastructure, including Apple services, Google/Firebase services, browser push services, hosting providers, domain providers, and email or support providers. Your use of palmpush may also be subject to third-party terms, operating system settings, browser settings, app store rules, and platform requirements.
We are not responsible for failures, delays, restrictions, policy changes, account actions, outages, or data handling by third-party services except where applicable law does not allow that responsibility to be excluded.
11. Intellectual property
palmpush, its name, branding, website, app, SDKs, service materials, and software are owned by the palmpush operator or its licensors.
Subject to these terms, you receive a limited, revocable, non-exclusive, non-transferable right to use palmpush for its intended purpose. These terms do not transfer ownership of palmpush or its intellectual property.
You retain rights you already have in notification content you send, but you grant us the rights needed to process, transmit, store, display, and operate on that content for the purpose of providing, securing, and maintaining palmpush.
12. Changes, suspension, and termination
We may change, suspend, restrict, delete, or discontinue palmpush or parts of palmpush at any time, especially if needed for security, reliability, legal compliance, provider requirements, abuse prevention, or maintenance.
We may block requests, disable listeners, delete data, or suspend access if we reasonably believe that use of palmpush violates these terms, creates risk, causes operational problems, infringes rights, or is unlawful.
You may stop using palmpush at any time.
13. No warranties
palmpush is provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, non-infringement, security, and uninterrupted operation.
14. Limitation of liability
To the fullest extent permitted by applicable law, the palmpush operator is not liable for any loss, damage, claim, cost, or expense arising from or related to:
- Missed, delayed, duplicated, incorrect, unauthorized, or failed notifications.
- Loss of data, notification history, listener access, or listener tokens.
- Exposed, guessed, leaked, shared, or misused listener tokens.
- Service interruptions, maintenance, outages, bugs, or security incidents.
- Third-party push services, hosting services, operating systems, browsers, app stores, networks, or devices.
- Lost profits, lost revenue, lost business, lost goodwill, lost savings, or indirect, incidental, special, consequential, exemplary, or punitive damages.
Nothing in these terms excludes or limits liability where liability cannot be excluded or limited under applicable law, including liability for intent, gross negligence, injury to life, body, or health, mandatory product liability, or mandatory consumer protection rights.
15. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold the palmpush operator harmless from claims, damages, losses, liabilities, costs, and expenses arising from your unlawful use of palmpush, your notification content, your violation of these terms, or your violation of third-party rights.
16. Governing law and venue
These terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules, unless mandatory consumer protection laws require otherwise.
Where a binding choice of venue is legally permitted, the courts at the operator's registered office in Germany have jurisdiction. Otherwise, disputes may be brought before the courts that have jurisdiction under applicable law.
